An orchard is a working farm — uneven ground, ladders, bees, and weather. Wisconsin law requires we post the notice below; we want you to actually read it.

Notice

A person who observes or participates in an agricultural tourism activity on this property assumes the risks inherent in the agricultural tourism activity. Risks inherent in the agricultural tourism activity may include conditions on the land, the unpredictable behavior of farm animals, the ordinary dangers associated with equipment used in farming operations, and the potential that a participant in the agricultural tourism activity may act in a negligent way that may contribute to injury or death. The agricultural tourism provider is not liable for the injury or death of a person involved in an agricultural tourism activity resulting from those inherent risks.

Inherent risks

What that
means, plainly.

Wisconsin statute §895.524 defines four categories of “inherent risk” on an agricultural-tourism property. By visiting Harvest & Crate you accept these risks.

    The land itself

    Surface and subsurface conditions of the land, and the natural condition of vegetation and water on the property. Hills, holes, mud, roots, branches, ponds and creeks.

  2. 02

    The animals

    The unpredictable behavior of wild, domestic, or farm animals on the property — including bees and wasps that come with any orchard in fruit.

  3. 03

    The equipment

    The ordinary dangers of structures or equipment used where crops are grown or animals are raised — ladders, picking poles, wagons, fencing, and the rest.

  4. 04

    Other visitors

    The possibility that another participant may act in a negligent manner — including by failing to follow instructions or to exercise reasonable caution — and that this may contribute to your injury.

Limits on this notice

This notice does not waive liability for conduct committed with willful or wanton disregard for the safety of others, or for an injury caused intentionally. (See Wis. Stat. §895.524(2)(b).)
